Business Banking dispute solutions

Business Banking and Small Business banking dispute solutions - IBAS find that many business banking disputes arise in what were previously considered ‘good banking relationships’. A change of bank manager / branch or business centre / bank business control unit, can provoke ‘personality’ issues between bank and business. These issues can become intense, particularly where new bank management seeks control of the business by enforcing changes, whilst also enforcing payment of extra charges and fees. The many ex-millionaires who have approached IBAS for assistance would attest to how quickly 'good relations' turned sour when market conditions or banking personnel changed and also how banking 'friends' then became business predators.

During last year IBAS advised and assisted business members with Business Banking solutions, providing business bank account analysis and business banking solutions to a wide range of banking disputes, issues and allegations involving bank facilities and banking, these include:

Proven thefts from company bank accounts by company employees and associated money laundering – IBAS has analyzed, investigated and collated evidence in these cases and calculated losses based on the facilities in place at the time. There have also been many allegations which include Bank breach of contract, bank forgery of security documents, bank misrepresentations in obtaining security, plus the usual ‘culprits’ with business current account bank overcharging on interest and business current account bank overcharging for double debits and fees. It is only by a full business bank account analysis that many errors and mistakes are found. Business bank loan accounts double charged over a period of years and regular disputes involving bankers pressuring businesses for more assets, lower borrowings, higher personal guarantees and also personal guarantees secured on family homes.

SFLGS Business Failures - more have been evident in the borrowing range from 100k to 250k during the last year. We have provided members with pre-litigation assistance on issues ranging from company loss, bank mistake, security taking, debenture taking and debenture registration and the taking of and 'calling up' of associated bank personal guarantees.

SME Business Banking dispute solutions, analysis and investigations of disputes, involved tracing ‘lost’ bank accounts, moved and then ‘lost’ in an offshore bank, allegations of asset ‘mining’ by bank managers and bank recovery departments, bank lending on undervalued property, bank lending on overvalued property, unauthorized cheque and BACS payments by bank branches, bank paying outside mandates for business accounts, UK overcharging on business banking current accounts/ loans/ guarantees/ mortgages, banks requiring greater security for company borrowings but also reducing lending, personal bank guarantees being called on by bank many years after business directorships ceased, business bank current accounts/ mortgages/ loans being moved (or removed) from branch to debt recovery department / specialized lending unit / business support unit / business recovery support unit, intense or aggressive pressure from bankers to reduce business borrowings / provide more business assets or pressure to factor with a bank factoring company.

We challenge banks hard on their performance but we also have a professional relationship with them. We are adversarial when it is required but we are always professional in what we do.
